In recent years, getting a divorce has become more accessible and less time-consuming for many couples. Uncontested divorce, a popular option among those seeking a simpler path to ending their marriage, requires both parties to agree upon all aspects of the separation. One of the biggest advantages of uncontested divorce is the potential to avoid a lengthy court appearance. This article explores the possibility of obtaining an uncontested divorce in Florida without a court appearance.

Florida has its own laws and regulations regarding uncontested divorce. These laws have continuously evolved to accommodate the changing needs of couples seeking separation. It is essential to be well-informed about the specific requirements and procedures to ensure a smooth and efficient uncontested divorce process in Florida.

An uncontested divorce is a type of divorce in which both parties have agreed to the terms and conditions, including matters like property distribution, child custody, child support (strictly governed by Florida law), and spousal support, without help from the court. This makes the process quicker, simpler, and more cost-effective than a contested divorce.

To proceed with an uncontested divorce in Florida, both parties must meet certain requirements:

  1. Agreement: Both spouses must have agreed on all aspects of the divorce, including property division, child custody, child support, and alimony.
  2. Residency: At least one of the spouses must be a resident of Florida for at least six months before filing for divorce.
  3. No Court Appearance: In Florida, it is possible to finalize an uncontested divorce without needing an in-court appearance if all issues have been resolved and both parties have signed the necessary paperwork.

Interestingly, St Johns, Putnam, Flagler and Volusia counties offer an alternative route for an uncontested divorce – a hearing option via Zoom with no in-court appearance. These counties will process a divorce fulfilling all requirements in Florida without mandating an in-court appearance, provided the case is an uncontested Florida divorce. The process is done electronically, by mail, and using Zoom to telecommunicate, reducing the need for actual court appearances.

This option provides an additional layer of convenience and simplicity for couples who agree on all significant divorce-related issues and seek the most efficient path to the dissolution of their marriage. Nevertheless, the guidance of an experienced mediator remains invaluable to navigating the legal landscape and ensuring the documents are completed properly.

How it works: You and your spouse will make a Zoom appointment with your mediator. Your mediator will go over all documents necessary to fulfill the requirements of your divorce and assist in completing all of them. Once documents are completed and the terms of the dissolution are agreed upon, the mediator will provide you with a copy of your divorce package. You and your spouse will be responsible for having documents notarized and filing the documents at the appropriate county courthouse. Many courthouses provide notaries; there are also online notaries available as well – very convenient.

All counties require a filing fee, the average fee is $415 to file, depending on your county. Once your documents are accepted by the clerk, your divorce can be finalized in an average of 45 to 60 days, depending on your county. Don’t forget divorcing parents are required to take parenting classes (many offered online), the courthouse clerk can advise you of your options.

The no court appearance option provides a streamlined and efficient process for those who can agree on all aspects of their divorce. For those who qualify, the uncontested divorce process in Florida involves preparing the necessary paperwork, signing the documents before a notary public, and submitting them to the court for approval.
